JULY 2024 UPDATES OF COURT CASES FILED AND MONITORED BY LAWYERS ALERT

 

Abuja - Field Office

 

  1. SUIT NO: FHC/ABJ/CS/642/2024 Between Incorporated Trustee of Lawyers Alert NG vs Abuja Environmental Protection Board & 3 ors

    The case borders on the harassment and human rights violation of women arrested on the streets of Abuja on the allegation of being sex workers by the FCT Ministerial Task Force, which includes the AEPB, the Nigeria Police, and the Nigerian Army. LA filed a suit at the Federal High Court seeking a declaration that the provisions of Section 6 of the Abuja Environmental Protection Board Act, 1997, or any other provision, do not give the AEPB the power to arrest women suspected to be sex workers or to harass women in Abuja, either by themselves or through other enforcement agencies. The suit came up for hearing on July 2, 2024. However, the 1st to 3rd Respondents served Lawyers Alert with their Counter Affidavit and Notice of Preliminary Objection just a day before the hearing date. The Court could not proceed as LA requested an adjournment to respond to these documents. The case was adjourned to October 9, 2024, for the hearing.

     

  2. SUIT NO: FHC/ABJ/CS/642/2024 BETWEEN Incorporated Trustee of Lawyers Alert NG VS Minister of Health & 2 Ors

    LA instituted a new SIL on TB at the Federal High Court in Abuja, where we seek to use the instrumentalism of law to compel the Minister of Health to expand the frontiers of People Affected by Tuberculosis (PATB) Rights and address issues of stigma and discrimination. The suit came up on the 4th of July, 2024, for the hearing of our application to amend; however, the court didn’t sit because his Lordship was under the weather. The case was adjourned to the 26th of September,2024 for a hearing.

     

  3. ECW/CCJ/APP/25/21 Lawyers Alert Initiative for Protecting the Rights of Children, Women, and the Indigent v. Federal Republic of Nigeria

    The case centers on provisions of some sections of the Penal Code of the Northern Region and Criminal Code of the Southern Region of Nigeria, which violates and disregards the provisions of some articles of the African Charter on Human and People’s Rights. LA has presented the above case before the ECOWAS Court seeking among other reliefs declarations that the Vagrancy Laws should be declared inconsistent with the Provision of the African Charter on Human and People’s Rights.

    The case came up on the 3rd of July, 2024, for a ruling on the motion filed by LA seeking to amend its originating processes. The court granted the motion and deemed the amended application as properly filed. A new date will be communicated to the parties.


Makurdi – H/Q Office


  1. STATE VS GODWIN MARK IORPUU

    This case was initiated by LA through the Ministry of Justice, involving the rape of a 6-year-old survivor. The matter is before High Court 4 sitting in Makurdi. The matter came up on the 25th of July 2024, for the continuation of hearing. Defense Witness (DW) 3 was absent in court thus an adjournment was sought and obtained. The matter is adjourned to 17th September for continuation of defense.
